公通字[2014]17号各省、自治区、直辖市高级人民法院,人民检察院,公安厅、局,解放军军事法院、军事检察院,新疆维吾尔自治区高级人民法院生产建设兵团分院,新疆生产建设兵团人民检察院、公安局:为依法惩治利用具有赌博功能的电子游戏设施设备开设赌场的犯罪活动,根据《中华人民共和国刑法》、《最高人民法院、最高人民检察院关于办理赌博刑事案件具体应用法律若干问题的解释》等有关规定,结合司法实践,现就办理此类案件适用法律问题提出如下意见:一、关于利用赌博机组织赌博的性质认定
