在没有废除死刑的当下,限制死刑的适用是我国刑事立法以及司法过程中的基本原则,而被告人对受害人民事赔偿的程度,是司法实践中限制死刑适用的有效措施。
In the absence of the abolition of the death penalty, the restriction of the application of the death penalty is the basic principle in our country’s criminal legislation and judicial process, and the extent of defendant’s civil compensation to the victim is an effective measure to restrict the application of death penalty in judicial practice.
