犯罪是一种社会现象,犯罪的根源在社会,任何社会都不会杜绝犯罪现象的发生,预防和控制犯罪是社会的共同责任。要想达到预防与控制犯罪的目的,仅仅立足于惩罚与打击,单靠制定科学的刑事法律规范来惩罚罪犯以发挥其一般和特殊预防功能是不够的。本文试图把意大利犯罪社会学派所侧重的刑罚个别预防之功利性价值作为思考的出发点,并在此基础上提出在建设和谐社会过程中所应采取的一些预防和控制犯罪的途径及措施。
Crime is a social phenomenon. The root of crime is in society and no society will stop the crime. The prevention and control of crime are the common responsibility of society. To achieve the purpose of prevention and control of crime, it is not enough to rely solely on punishments and strikes. It is not enough simply to formulate scientific criminal law norms to punish criminals for their general and special preventive functions. This paper tries to take the utilitarian value of individual prevention of penalty focused on by criminal societies in Italy as starting point, and on this basis, puts forward some measures and ways to prevent and control crime in the process of building a harmonious society.
