自20世纪90年代以来,我国颁布了大批法律、法规和规章,其内容涵盖了国家管理的主要领域,使国家管理主要依靠政策文件治理转向了依法治理。依法治理离不开权力的制约监督。本文认为,目前我国公共治理中监督体制及其运作机制存在不足之处,其表现是:监督机构职责分工不明,缺乏协调性;监督主体权能不实,缺乏权威性;监督过程中制度缺失,缺乏保障性;监督者和被监督者,缺乏自觉性。为提高监督的民主化、科学化和法制化水平,本文建议优化权力配置,强化人大监督,整合行政监督,改善司法监督,健全政党监督,激励社会参与监督。
Since the 1990s, a large number of laws, regulations and rules have been promulgated in our country, covering the major areas of state administration. State management has mainly shifted from governing the policy documents to governing the country according to law. Administering according to law is inseparable from the restriction of power and supervision. This paper argues that there are some deficiencies in the supervision system and its operation mechanism in public governance in our country at present. Its performance is: the responsibility division of the supervision body is unclear and lack of coordination; the power of the supervision body is untrue and the authority is lacking; the system is lacking and lacking in the supervision process Security; supervisors and supervisors, lack of consciousness. In order to improve the level of democratization, scientificization and legalization of oversight, this paper proposes to optimize the allocation of power, strengthen oversight of the people’s congress, integrate administrative supervision, improve judicial supervision, improve party supervision, and encourage the community to participate in supervision.
