国家经贸委负责人12月13日在新闻发布会上透露,为民众所关注的《反垄断法》的起草工作正在抓紧进行,不久将报国务院审批。这是一则令人喜忧参半的消息。喜的是,《反垄断法》即将浮出水面;忧的是,尽管早在1994年《反垄断法》就被列入八届人大常委会立法规划之中,而《反垄断法》至今仍停留在草案乃至《草案大纲》阶段。 然而,该消息发布一周后,记者在电话采访国家经贸委有关人士时获悉,《反垄断法》正式出台还须两三年时间。这位官员对此持谨慎态度。《反垄断法》为何千呼万唤,犹抱琵琶半遮面?就此,记者采访了中国人民大学法学院教授史际春。
