1、关于企业职工奖惩的主要依据关于企业职工奖惩问题的规定依据主要有:(一)国家的法律、法规、规章、政策等,如《企业职工奖惩条例》〔国发(1992)59号〕、《国营企业辞退违纪职工暂行规定〔国发(1986)77号〕、《广东省国营企业辞退违纪职工实施细则》〔粤府(1986)134号〕等。(二)企业与职工依法签订的《劳动合同》、《集体合同》:(三)企业依法制订的厂规厂纪、《员工守则》等等。2、《企业职工奖惩条例》的适用范围《企业职工奖惩条例》适用于全民所有制企业和城镇集体所有制企业的全体职工。换言之,全民及城镇集体所有制企业的固定职工(含企业任命的干部)、合同制职工、临时工等的奖惩问题,适用于《企业职

The Major Basis for Reward and Punishment of Enterprise Workers The regulations on rewards and punishments of enterprises are mainly based on the following: (1) The laws, regulations, rules and policies of the state, such as the Regulations on Reward and Punishment of Enterprises Employees (Guo Fa [1992] No. 59) , “Interim Provisions on Dismissal of State-owned Enterprises Disobeying Workers and Workers [Guo Fa (1986) No. 77], Regulations on the Dismissal of Violators of Discipline by State-owned Enterprises in Guangdong Province [Yue Fu (1986) No. 134]. (2) The ”Labor Contract“ and ”Collective Contract“ signed between the enterprise and its employees in accordance with the law: (3) The factory rules and regulations, the ”staff code“ and so on formulated by the enterprise according to law. 2, ”Employee Compensation and Reward Ordinance,“ the scope of ”reward and punishment of workers Ordinance“ applies to all the people-owned enterprises and urban collective-owned enterprises of all employees.
