在回顾传统国际法有关国家财产豁免的学说的基础上 ,分析了影响统一化进展的深层次原因 ,认为这些原因将决定有关豁免的统一化的发展趋势 ,有限豁免原则将取代绝对豁免。据此 ,我国应抛弃绝对豁免原则 ,注意确立国家持股公司的财产所有权和国家的股东地位 ,完善实体和程序方面的规定 ,维护我国的国家利益
On the basis of reviewing the traditional international law on state property exemption, the paper analyzes the underlying causes that affect the progress of the unification. It is concluded that these reasons will determine the unification trend of the exemption and the principle of limited exemption will supersede the absolute exemption. Accordingly, our country should abandon the principle of absolute immunity, pay attention to establishing the property ownership of state-owned holding companies and the country’s shareholder status, improve the substantive and procedural provisions, and safeguard China’s national interests
