司法和谐是在当今司法面临着为构建和谐社会这一宏伟目标提供服务和保障的背景之下提出的。而现阶段,司法工作面临的最大问题是审判本身存在着一些不和谐的地方,审判体制内与体制外的矛盾依然比较突出。在这种状态下,审判工作面对的又是社会转型时期涌现出的各种新矛盾、新问题,法院所承担的化解矛盾、促进社会和谐的任务越来越重。本文阐述了司法和谐的内涵、构建司法和谐的必要性以及对构建和谐司法提出了几点建议。
Judicial harmony is put forward under the background that the judiciary is facing the service and guarantee for the grand goal of building a harmonious society. At the present stage, the biggest problem that the judicial work faces is that there are some inconsistencies in the trial itself, and the conflicts within and outside the trial system are still outstanding. In this state, the trial work is confronted with all kinds of new contradictions and new problems that emerged during the social transition. The courts are shouldering more and more tasks of resolving conflicts and promoting social harmony. This article expounds the connotation of judicial harmony, the necessity of building judicial harmony and some suggestions on how to build a harmonious society.
