民族主义和少数民族在世界上一直存在。然而,国际法上一直没有准确的少数民族定义,也没有具体的法律基础来描述少数民族。因此,从国际法视野下对少数民族进行定义,并对其判断标准和方法进行分析,对少数民族权利的保护至关重要。少数民族的保护经历了从自然权利学说的早期阶段到国际条约的发展阶段。
Nationalism and ethnic minorities have always existed in the world. However, there has been no accurate definition of national minorities in international law and no specific legal basis for describing ethnic minorities. Therefore, the definition of ethnic minorities from the perspective of international law and the analysis of their criteria and methods of determination are of crucial importance for the protection of the rights of ethnic minorities. Protection of ethnic minorities has gone from the early stage of the theory of natural rights to the stage of development of international treaties.
