保护夫妻合法财产权益与维护第三人合法利益是体现现代婚姻家庭法兼顾个人利益与社会利益的必然要求。实践中,怎样妥善处理夫妻与第三人之间的债权债务关系就涉及到对这两种利益的平衡问题。为了更好地处理好这个问题,本文将通过对司法实践中夫妻与第三人之间常见的纠纷类型进行区分,并有针对性地提出相应的解决措施,以期能有助于立法的完善和司法的公正处理。
Protecting the legal property rights of the couple and safeguarding the legitimate interests of the third party are the inevitable requirements of the modern marriage and family law taking into consideration both individual and social interests. In practice, how to properly handle the relationship between the claims and debts of the couple and the third party involves the balance between the two interests. In order to deal with this problem better, this article will distinguish the common types of disputes between husband and wife and the third party in judicial practice, and put forward corresponding solutions in a targeted way in order to help improve the legislation and Judicial justice.
