一、宪法、立宪主义与亚洲立宪主义亚洲立宪主义作为一个专门的概念,还是最近十几年的事情。1976年在美国召开的“亚洲立宪主义问题国际学术研讨会”初步提出了这个命题,1989年在日本召开的第一届亚洲宪法论坛上比较系统地论证了这个概念。这是指按照亚洲的政治哲学,以亚洲人的宪法观解决亚洲社会里存在的宪法现象的原理与规则。~①这反映出亚洲社会在追求宪政的道路上摒弃西方中心主义的宪法价值观念,寻找适合自己道路的国家治理模式的一种自我觉醒。
I. Constitution, Constitutionalism and Asian Constitutionalism Asian constitutionalism as a specialized concept is still the last ten years. This proposition was tentatively proposed in the 1976 “International Symposium on the Asian Constitutionalism” held in the United States. This concept was systematically demonstrated in the first Asian Constitutional Forum held in 1989 in Japan. This refers to the principles and rules for settling the constitutional phenomena existing in Asian societies according to Asian political philosophy and the Asian constitutional view. This shows that in the process of pursuing constitutionalism, Asian society has abandoned Western constitutional values and sought a self-awakening of state governance that suits its own path.
