随着公益事业的迅猛发展,公益性作品应运而生,在传播积极理念、促进社会和谐上卓有成效。公益性作品不同于一般著作权客体,其作品本身的公益性直接影响着其利益平衡格局。本文通过探讨公益性作品的概念与性质,分析现有著作权制度,以期明晰公益性作品在当前著作权制度中所处状况,为其著作权制度构建提出良策,保障社会主义核心价值观的传播与实现。
With the rapid development of public welfare undertakings, public welfare works came into being, which made great achievements in disseminating positive ideas and promoting social harmony. Public welfare works is different from the general copyright object, the public welfare of the work itself directly affects the balance of interests. By examining the concept and nature of public welfare works, this paper analyzes the current copyright system in order to clarify the current situation of public welfare works in the current copyright system and provides good solutions for the construction of its copyright system to ensure the dissemination and realization of the socialist core values.
