由于驰名商标所蕴含的巨大商业价值,更易吸引侵权者的目光,因此,对驰名商标给予超出一般商标更广泛的特殊保护,这是保护权利人利益并打击侵权人的客观要求。本文分析了驰名商标特殊保护的意义以及特殊保护的主体、内容,针对我国驰名商标特殊保护所存在的问题,提出了相应的完善措施,以期进一步完善我国驰名商标特殊保护制度。
Due to the great commercial value inherent in well-known trademarks, it is more likely to attract the attention of infringers. Therefore, giving special protection to well-known trademarks more widely than general ones is an objective requirement to protect the interests of rights holders and to crack down infringers. This article analyzes the significance of the special protection of well-known trademarks and the subject and content of the special protection. In view of the problems existing in the special protection of the well-known trademarks in our country, this paper puts forward corresponding measures to improve the special protection system of well-known trademarks in our country.
