农业是国民经济的基础,水利是农业的命脉。党的十七大报告多次提到水利工作,强调要加强以水利设施为主的农村基础设施建设。针对个别单位在基本建设中忽视水利工程的重要性,占用农业灌溉水源、灌排工程设施的现象,水管单位要应用国家关于《占用农业灌溉水源、灌排工程设施补偿办法》来维护自己的合法权益,要求占用者进行经济损失补偿或兴建效益相当的替代工程,那么从哪些方面进行经济损失补偿呢?本文针对这一问题,用实例从5个方面进行了探讨。
Agriculture is the foundation of the national economy. Water conservancy is the lifeblood of agriculture. The report of the 17th National Congress of the CPC has repeatedly mentioned water conservancy work, emphasizing the need to strengthen rural infrastructure construction mainly based on water conservancy facilities. In view of the importance of individual units neglecting water conservancy projects in capital construction and occupying agricultural irrigation water sources and irrigating and discharging construction facilities, water pipe units should use their own national laws to safeguard their legal rights by “taking measures for compensation of agricultural irrigation water sources and irrigation and drainage facilities” Rights and interests, requiring occupants to carry out compensation for economic losses or constructing alternative projects with similar benefits, then from which aspects should economic losses be compensated? In this paper, five cases are discussed with examples.
