米兰达规则是一项重要的刑事诉讼规则。该规则要求警察在拘留讯问犯罪嫌疑人之前必须告知犯罪嫌疑人其不被强迫自证其罪的权利以及获得律师帮助的权利,否则获取的供述将不被法庭所采纳。本文认为在我国确立米兰规则有利于明确犯罪嫌疑人供述的可采性标准。还有利于将我国当下的默示沉默权明示化,消除立法模糊性,以更好地实现制度价值。
The Miranda rule is an important criminal procedure rule. The rule requires the police to inform the criminal suspects of their rights not to be compelled to commit self-incrimination and the right to be assisted by a lawyer before detention interrogates the suspects or the confession obtained will not be adopted by the courts. This article holds that the establishment of Milan rule in our country is conducive to clarifying the admissibility standard of criminal suspects. But also help clarify the implied right of silence in our country now and eliminate the ambiguity of legislation in order to better realize the value of the system.
