上市公司报道侵权是新闻侵权的一种类型,是指新闻工作者和新闻媒体在报道上市公司过程中侵害上市公司及其投资人合法权利的行为。近些年来,随着上市公司报道的大量增加,以及上市公司及其投资人法律意识的增强,人们对于上市公司报道的要求越来越高,与新闻侵权有关的纠纷甚至诉讼不断出现,因此,如何在法律理论和新闻实践中界定正当的上市公司信息报道及舆论监督与新闻侵权的区别,如何采取措施防范、免受新闻侵权诉讼的困扰等问题,摆在了新闻机构和新闻工作者的面前。
