数字技术和网络技术的高速发展改变了传统版权的传播模式,同时出版商的主导下版权法逐步强化了网络作品的保护,但也进一步侵害了人们对于文化共享与传播的自由。在公共领域研究中心的支持下,美国创设了旨在促进文化自由传播的知识共享组织(Creative Commons),并通过一系列知识共享协议(Creative Commons Licenses)来实现自由共享。目前该组织通过在各个司法区域设立推广项目而使知识共享为全世界所认识,同时也掀起了一阵关于CC研究的热潮。本文探讨引入CC对我国的网络空间发展的必要性,同时通过总结目前CC在中国内地推广存在的困境,并提出可行性建议。
The rapid development of digital technology and network technology has changed the mode of transmission of traditional copyright. At the same time, the copyright law led by publisher gradually strengthens the protection of online works, but also further infringes people’s freedom of cultural sharing and communication. With the support of the Public Domain Research Center, the United States created Creative Commons to promote the free flow of culture and shared it freely through a series of Creative Commons Licenses. At present, the organization has made knowledge sharing known around the world through setting up promotion projects in various judicial regions, and at the same time, it has triggered a wave of research on CC. This article explores the necessity of introducing CC into the development of cyberspace in China. At the same time, by summarizing the current dilemmas of promoting CC in mainland China and putting forward feasible suggestions.
