行政许可范围内存在着自由裁量权。行政许可中的自由裁量权是法律赋予行政机关的一项重要权力。但是,如何行使行政许可中的自由裁量权以及如何有效防范和控制行政许可中自由裁量权的滥用,却是一个比较难解决的问题。本文试图从行政许可自由裁量权的定义着手,分析了行政许可自由裁量权存在的原因,以及对如何防范和控制行政许可中自由裁量权的滥用进行论述。
There is discretion within the scope of administrative permission. Discretion in administrative licensing is an important power given to the executive by law. However, how to exercise discretion in administrative licensing and how to effectively prevent and control the abuse of discretion in administrative licensing is a rather difficult issue to be solved. This article attempts to start with the definition of administrative discretion, analyzes the reasons for the existence of administrative discretion, and discusses how to prevent and control the abuse of discretion in administrative licensing.
