本文以国际私法的功能为视角,通过对和谐世界理念与国际私法诸范畴之间的对比,阐明国际私法在法律关系主体、责任范式、效率、权利义务范式、程序正义等方面具有天然的和谐气质和范畴,认为国际私法的和谐理念代表了一种全新的法律文化与法律方向。通过将国际私法的和谐理念与主流的哲学和国际思潮相比,得出国际私法将在和谐世界的建设中发挥重要作用的结论。
From the perspective of the function of private international law, this paper illustrates the contradiction between the concept of harmonious world and the categories of private international law, and expounds the natural harmony of private international law in the aspects of the subject of legal relationship, responsibility paradigm, efficiency, paradigm of rights and obligations, procedural justice And category, that the concept of harmony of private international law represents a new legal culture and legal direction. By comparing the concept of harmony in private international law with the mainstream philosophical and international thoughts, we come to the conclusion that private international law will play an important role in the construction of a harmonious world.
