2011年日本“3·11”大地震的发生及其后福岛第一核电站的燃料泄漏,引起了全社会范围的恐慌。在本已十分严峻的客观情况下,社会上爆发的流言蜚语更加剧了这种紧张气氛。在“西化”颇深,“自诩”民主的日本,政府向来注重保护言论自由,然而此次面对互联网上的流言蜚语时却摆出了高压态势,这无疑是值得研究和深思的。本文从法律角度出发,对这一现象背后的原因进行了分析,对于我国当前开展的清理网络谣言犯罪行动具有一定的参考意义。
The 2011 Japan “3.11” earthquake and its subsequent Fukushima Daiichi nuclear power plant fuel leak caused a panic-stricken society. In a very serious and objective situation, gossip erupted in society exacerbates this tension. In Japan, where “Westernization” is rather deep and “self-sustaining ” democracy has always been focused on the protection of freedom of speech. However, it was undoubtedly worth studying when confronted with gossip on the Internet Thoughtful. This article analyzes the reasons behind this phenomenon from a legal point of view, which is of certain reference significance for our current criminal activities of clearing up network rumors.
