“仁”在人类不得不面对战争,又努力避免战争的损害之初就与战争结下了不解之缘。战争法的使命决定了它在处理“仁”与战争之间的紧张关系的过程中必须表现出高度的责任感。先秦时期战争法思想的这一使命,是通过选取战争中的某一关键点(战争目的、战争的合法性以及战争胜负的决定因素),将其与“仁”相联系,从而实现了战争法思想的“仁本”关怀,为日后战争法平衡军事必要与人道主义的实践提供了宝贵的思想资源。
