专利权、专有技术是当代企业经营战略的核心,是参与市场竞争的重要手段,在企业内部建立和完善专利权保护制度是企业构筑法律风险防控体系的重要举措。专利权的保护在专利侵权行为日趋复杂的情形下,不再局限于权利要求的文字内容,引入等同原则判定专利侵权行为已是现今形势下的常规手段,故熟悉与掌握等同原则并运用到企业的专利权防控体系之中,将能更好的保护企业的知识产权不受侵犯,增强企业竞争力,从而使企业在复杂的经济环境中立于不败之地。
