科学数据共享已得到科学界的认可和重视,但更大范围的开放和获取仍面临许多的困难。首先从法律层面对科学数据的权利归属进行梳理,从现有的知识产权法律来看,提倡原始数据的共享将减少法律方面的障碍;其次对科学数据共享的利益主体及其关系进行分析,提出促进科学数据共享利益平衡的建议。
Scientific data sharing has been recognized and valued by the scientific community. However, there are still many difficulties in opening up and obtaining a wider scope. First of all, we review the ownership of scientific data from the perspective of law. From the point of view of existing intellectual property law, advocating the sharing of raw data will reduce the legal obstacles. Second, we analyze the stakeholders of scientific data sharing and their relations, Proposals to promote the balance of interests in scientific data sharing.
