党和国家在加强权力制约与监督的背景下,提出推行权力清单制度。作为一项开创性的制度,对制度相关要素进行研究界定,是权力清单制度在具体构建和实际推行中不可回避的基本问题。权力清单的权力属性,本质是国家权力中的行政权,外在表现为行政职权。权力清单的权力主体,不限于地方政府及其部门。权力清单的权力来源,因行政行为性质的不同而不同,侵益行为的权力依据必须是规章以上的法律规范性文件,给付行政则可以规范性文件作为其权力依据,但应有预算依据和程序规范。权力清单的权力范围应包括执行权、决策权和监督权。
