我国《选举法》是几经修改、与我国民主发展水平相适应的法律。现行的《选举法》,于1979年7月由第五届全国人大第二次会议在1953年《选举法》的基础上,重新制定和颁布。它规定了选举的原则、方法、组织和程序,对原先的选举制度作了一系列重大的修改:进一步扩大了普选权;将直接选举的范围扩大到县一级,规定一律实行差额选举;规定一律采用无记名投票;选区划分改为按生产单位、事业单位、工作单位和居住状况的复合划分方式;规定选民或代表3人以上联名均可推荐代表候选人;计票方式由相对多数改为绝对多数;规定推荐人应向选举委员会介绍候选人的情况;就选民和选举单位对代表的监督、罢免作出专门规定。这部重新制定的《选举法》,较好地体现了我国选举制度的普遍原则、平等原则、直接选举和间接选举并用原则、无记名投票原则和权利保障原则。1982年和1986年,全国人大和全国人大常委会又先后对《选举法》进行了两次修改,修改内容主要包括:将各党派、团体或选民对代表选候人的宣传都限定为在选民小组
Our “Election Law” is a few laws that have been amended to meet the level of democratic development in our country. The current Electoral Law was re-enacted and promulgated on the basis of the Election Law of 1953 by the Second Session of the Fifth National People’s Congress in July 1979. This newly enacted Election Law better reflects the general principle of the electoral system in our country, the principle of equality, the principle of direct election and indirect election, the principle of secret ballot and the guarantee of rights. In 1982 and 1986, the NPC and the NPC Standing Committee successively amended the Electoral Law two times.
