本文以调查材料为出发点,详细描述了湖北省钟祥市石巷村的赡养习惯。在界定了“家”和“分家”的概念后,按多子家庭、独子家庭和无子家庭三种情形,逐一对赡养习惯进行了描述和分析,并试图从中提炼出一般的赡养规则。最后,本文以基层法院的案卷材料为依据,结合习惯和现行法,对赡养纠纷及其解决方式作了简要的分析。
Based on the survey materials, this paper describes in detail the maintenance habits of Shixiang Village, Zhongxiang City, Hubei Province. After defining the concepts of “home ” and “dividing the home ”, we describe and analyze the supporting habits one by one according to the three situations of multi-sub-family, single-child family and no-child family and try to extract the general The maintenance rules. Finally, based on the case files of the grass-roots court, this article makes a brief analysis of the disputable disputes and their solutions by combining the customary and current laws.
