各市州、县市区人民政府,省政府各厅委、各直属机构:1997年国家实施政策性破产以来,我省部分国有企业通过实施政策性关闭破产有序退出了市场,为我省优化经济结构和加快工业化进程起到了积极作用。随着企业改革不断深入,还将有一批企业关闭破产。为加强企业关闭破产管理工作,根据中央办公厅、国务院办公厅中办发[2000]11号、国务院办公厅国办发[2003]2号文件精神,经省人民政府同意,现将有关事项通知如下:一、加强企业关闭破产管理工作的基本原则(一)属地化管理的原则。关闭破产企业一旦宣告关闭破产,无论原隶属关系如何,所在市州、县市区人民政府要及时接管原破产企业所承担的社会职能,对其实行有效管理。(二)对关闭破产企业实施管理,坚持职能归并为主、新建社区管理机构为辅的原则,充分利用现有的各级基层行政机构,就近归并。地处偏远地区且管理相对独立的大型独立工矿企业关闭破产后,确有必要的,可设置新的社区管理机构。(三)机构设置要坚持精简、效能的原则,根据需要配备适当编制人员。

In order to strengthen the closure and bankruptcy management of enterprises, according to the spirit of the document issued by the Central General Office and the General Office of the State Council, issued by [2000] No. 11 and issued by the State Council General Office of the State Administration of the People’s Republic of China [2003] No. 2 and with the consent of the Provincial People’s Government, the relevant matters are now notified. As follows: I. Strengthening the basic principles for the closure of bankruptcy management of enterprises (A) The principle of territorial management. When a closed bankruptcy enterprise is declared closed and bankrupt, no matter how its original affiliation is, the municipal, county, and city people’s governments of the municipality must take over the social functions assumed by the original bankruptcy company in a timely manner and implement effective management. (2) Implementing management on closing down bankrupt companies, insisting on the principle that functions should be merged and supplemented by newly-built community management organizations, making full use of existing administrative agencies at all levels and merging them nearby. If a large-scale independent industrial and mining enterprise that is located in a remote area and has relatively independent management is closed down after bankruptcy, it is really necessary to set up a new community management agency. (3) Institutional settings should adhere to the principle of streamlining and efficiency, and staffing should be appropriately prepared as required.
