消费争议,是指消费者与经营者之间因消费者权益而发生的争议。消费者争议是有关消费者权益的争议。消费者权益是消费者在购买、使用商品及接受服务时而依法享有的权利和利益。消费者争议的发生或是由于其认为经营者的行为侵犯了合法权益,或者是由于消费者与经营者之间就与消费者权益有关问题具有不同的认识,因而发生争执。这种争议,从法律属性上看,属于民事权益争议的范畴。其具有如下特点:
Consumption dispute refers to the controversy between consumers and managers due to consumers' rights and interests. Consumer disputes are disputes over the rights and interests of consumers. Consumers' rights and interests are the rights and interests enjoyed by consumers in accordance with law when they purchase, use goods and receive services. Disputes arise as a result of consumer disputes arising out of perceived infringement of lawful rights and interests by the operator or due to different perceptions between consumers and managers regarding the rights and interests of consumers. This kind of dispute, from the legal attribute point of view, falls into the category of disputes over civil rights. It has the following characteristics:
