价格是商品价值的货币表现,它反映着一定的生产关系,主要表现为商品的经营者与消费者之间的经济关系。价格信号的正常显现和传递作用是市场机制得以健康运转的基本条件,而垄断行为的出现会打破正常的竞争秩序,使得价格机制难以正常发挥作用,甚至有学者认为一切垄断行为最终都以价格问题表现出来。反垄断法对垄断行为的调整不可避免地涉及价格问题。如何正确处理其与专门调整价格经济关系的价格法之间的关系,自然也就成为值得研究的问题。本文通过分析反垄断法与价格法冲突的表现,说明两部法律产生冲突的原因,并试图对如何协调冲突提出自己的设想。
Price is the monetary manifestation of the commodity value. It reflects a certain productive relationship, mainly manifested as the economic relationship between the merchant and the consumer. The normal appearance and transmission of the price signal is the basic condition for the market mechanism to operate healthily. However, the appearance of the monopolistic behavior will break the normal competition order, making it difficult for the price mechanism to play a normal role. How to correctly handle the relationship between the price law and the price law that specially adjusts the price economy naturally becomes a question that deserves research. By analyzing the performance of antitrust and price law conflicts, this article illustrates the reasons for the conflict between the two laws and attempts to put forward my own ideas on how to coordinate the conflicts.
