在现阶段我国市场领域的各类活动中,虚假宣传是一种常见的和严重的不正当竞争行为。《反不正当竞争法》对市场领域虚假宣传的规制,可查处利用广告方法之外进行虚假宣传的行为,扩大了查处的范围,并提高了行政处罚的力度。但由于是初次立法和客观情况所限,该法在不正当竞争行为列举等方面还不全面,对虚假宣传规制亦有不足。笔者结合实际提出修订相关内容的一些建议。
In various activities in the market of our country at this stage, false propaganda is a common and serious act of unfair competition. The Anti-Unfair Competition Law regulates the false propaganda in the market area by investigating and dealing with false propaganda outside the advertising method, expanding the scope of investigation and handling and raising the administrative penalties. However, due to the restriction of initial legislation and objective circumstances, the law is not comprehensive in the enumeration of acts of unfair competition and there are also deficiencies in the regulation of false propaganda. The author put forward some suggestions for revising the relevant content according to the actual situation.
