一、日常家事代理权的概念日常家事代理权是配偶权的重要内容之一,是指夫妻一方因日常事务在与第三人进行民事交往时所为法律行为,视为夫妻共同的意思表示,配偶他方承担连带责任。配偶权制度由来已久,它是直接标志和象征婚姻关系特殊价值的重要法律规范,构成或者反映了婚姻关系中最基本的内容,是婚姻关系区别于其他社会关系的唯一标志。无论任何国家和地区的婚姻家庭法,事实上都存在着配偶权,司法实践也确认有配偶权。
