作为公民最基本的权利,人权区别于一般的权利,其保障的是公民最基本的生存与发展,不能够被让渡的,所以对于人权的尊重与保护是任何法律的前提和必然要求。法律虽然是自由的枷锁,但其对自由的限制也必须以人权的范围为最低的限度,在尊重和保障人权的前提下惩罚侵害他人的行为。刑法作为最为严厉的惩罚措施,其对于人权的尊重和保护就显得尤为重要,修改后刑诉法亦在第二条中明确提出了“尊重和保障人权”的内容。
As the most basic rights of citizens, human rights are different from ordinary rights. They guarantee the most basic survival and development of citizens and can not be surrendered. Therefore, respect and protection of human rights are the prerequisite and necessary requirement of any law. Although the law is the yoke of freedom, its restrictions on freedom must also punish violations against others on the premise of respecting and safeguarding human rights with the human rights scope as a minimum. Criminal law, as the most severe punitive measure, is particularly important for respect and protection of human rights. The amended Criminal Procedure Law clearly stipulates the content of “respecting and safeguarding human rights” in Article 2.
