最高人民法院《关于审理农村承包合同纠纷案件若干问题的意见》(以下简称意见)对无效农村承包合同的确认中,把“违背民主议定原则”作为确认农村承包合同无效的六要件之一。经济审判实践中,有相当一部分农村承包合同纠纷案件是以“违背民主议定原则”为由提起诉讼的。因此,能否正确地区分和认定是否“违背民主议定原则”,不仅关系到案件审理质量的好坏,而且对保障农村经济体制改革,发展农村商品经济也具有十分重要的意义。
Opinions of the Supreme People's Court on Several Issues Concerning Cases of Disputes over Rural Contract Contracts (hereinafter referred to as Opinions) In confirming invalid rural contract contracts, the principle of “violating the agreed principles of democracy” is taken as one of the six requirements for invalidating rural contractual contracts. In the practice of economic trial, a considerable number of cases of contract disputes in rural areas are litigated on grounds of “violating the principle of democracy.” Therefore, whether we can correctly differentiate and decide whether to “violate the principle of democratic agreement” is not only related to the quality of the case hearing, but also of great significance for ensuring the reform of the rural economic system and developing the rural commodity economy.
