农村集体经营性建设用地的入市,是当下中国土地改革的重要方向。但在试点地区的实际操作中存在着诸多难点和法律问题亟待解决,主要体现在:缺乏明确的价格机制;如何解决集体经营性建设用地抵押融资难的问题;小产权房是否可以转为合法;缩小政府征收土地的范围,使经营性建设用地可以自由进入市场;完善农民的社会保障,基本解决农民的后顾之忧等方面。解决这些难点与问题是推动其入市的关键。
The entry of rural collective-owned construction land into the market is an important direction for the current land reform in China. However, there are many difficulties and legal problems to be solved in the practical operation of the pilot areas, mainly due to the lack of a clear pricing mechanism; how to solve the problem of financing difficulties in the collectivist construction land; whether small property houses can be transformed into legal ones; Narrow the scope of the land that the government levies so that the land for commercial construction can enter the market freely, improve the social security of peasants and basically solve the worries of peasants.
