随着社会主义现代化建设的不断发展,知识产权作为一种无形的财产权引起了社会各界的高度关注,知识产权法价值分析也越来越受到学者的重视,其不仅涵盖了一般法的价值构成要素,而且涉及到特别法的价值内容。当前我国的知识产权法价值实现普遍存在观念、利益等方面的冲突与障碍,因此必须对其进行新的创新发展。本文着重对中国语境的知识产权法价值进行分析,为相关行业提供有效的参考。
With the continuous development of socialist modernization, intellectual property as a kind of invisible property rights has aroused great concern from all walks of life. The value analysis of intellectual property law is also paid more and more attention by scholars. It not only covers the value components of general law , But also related to the value of lex specialis. At present, the value of intellectual property law in our country has the common conflicts and obstacles in its concept, interest and other aspects. Therefore, it is necessary to carry out new innovation and development. This article focuses on the analysis of the value of intellectual property law in Chinese context and provides an effective reference for related industries.
