审判绩效是若干反映审判公正、效率和效果、规范、导向、激励、监督审判工作的评估指标体系。审判绩效体系的实践运行,促进了法院案件审判质量和效率的提升,但也产生了一些功利化现象,损害了司法公正和效率。文章试通过分析当前法院审判绩效功利化现象产生的原因和危害,提出一些对策建议,以期审判绩效评估体系的进一步完善。
Trial performance is a number of evaluation index system that reflects the fairness, efficiency and effectiveness of the trial, standardize, guide, encourage and supervise the trial work. The practice of the trial performance system has promoted the improvement of the trial quality and efficiency of court cases, but has also brought about some utilitarian phenomena and undermined the fairness and efficiency of the judiciary. This article tries to find out some countermeasures and suggestions by analyzing the causes and harms of the utilitarianization of judicial performance in the current court so as to further improve the evaluation system of judicial performance.
