本期研讨的主题是“检察机关侦查权及其法律属性”。我国检察机关侦查权及其法律属性是理论界关注的热点问题,它不仅涉及检察机关的性质,还关乎检察权与警察权、审判权的关系,是刑事诉讼法修改与司法体制改革不容回避的问题。本期选登的文章既有检察机关侦查权本源及其法律属性的研究,又有从政治学视野和现实必要性角度对检察机关侦查权的阐述,表达的观点与理由虽不无争议,但却力图梳理检察机关侦查权的形成历史、法律属性及其现实功能,并藉此澄清一些观念与理论上的误区。
The theme of this symposium is “the investigative power of procuratorial organs and their legal attributes.” The procuratorial organ's investigative power and its legal attribute are the hot issues that theorists pay close attention to. It not only relates to the nature of the procuratorial organ, but also to the relationship between prosecutorial power and police power and judicial power. It is unavoidable to revise the criminal procedure law and reform the judicial system problem. The articles selected in this period are not only the research on the origin and legal attribute of the procuratorial organ's investigative power, but also the explanation of the procuratorial organ's investigative power from the perspective of political science and the necessity of reality. Although there are no controversial views and reasons for expressing it, It seeks to sort out the formation history, legal attributes and the actual functions of the procuratorial organ's investigative powers and clarifies some misunderstandings on the concepts and theories.
