所谓著名商标,是指由省市级有关行政部门认定的、具有较高市场声誉和商业价值的商标。为了促进地方经济的发展,我国大多数省市级行政机关都通过地方性立法方式制订了自己的著名商标制度,如《上海市著名商标认定与保护暂行办法》、《北京市著名商标认定和保护办法》、《黑龙江省著名商标认定和保护暂行办法》、《山东省著名商标认定和保护暂行办法》、《湖南省著名商标认定与保护办法》、《河北省著名商标认定和保护条例》、《浙江省著名商标认定和保护条例》和《辽宁省著名商标认定和保护暂行办法》等等。
