行政垄断是我国在这种由计划经济体制向市场经济体制转型期所出现的争议比较大的问题,从根本上来讲,行政垄断是以行政权力为基础和后盾的垄断,是行政权力在经济领域的一个突出表现。它对我国的市场经济体制的形成有不可忽视的阻碍作用,因此非常有必要在反垄断法中对其进行规制。但是,在我国目前的经济背景和法律实践上,允许一定程度的行政垄断的存在也是有其合理性的。
Administrative monopoly is a controversial issue that our country appeared in this transitional period from planned economy system to market economic system.
