“我看好了市区里的一处小型高档公寓,可是后来一打听,才知道该公寓的土地性质属商业的,土地使用年限还剩下30多年,我很纠结,不知道该不该买。”近日,笔者接到一位市民打来的咨询电话。在这里,笔者建议广大市民在购房时有必要先搞清楚土地使用年限。法律对土地使用权按不同的用途规定了不同的使用年限,商业、旅游、娱乐用地40年,工业用地、教育、科技、文化、卫生、体育用地50年,综合或者其他用地50年,居住用地70年。也就是说,一般的商品房住宅都拥有70年的土地使用权。按照《物权法》第一百四十五条规定:

The law provides for different years of use of land use rights for different uses, 40 years of commercial, tourism and entertainment land use, 50 years of land for industrial use, education, science and technology, culture, health and sports, 50 years of comprehensive or other land use, residential land 70 years. In other words, the average commercial housing has 70 years of land use rights. According to “Property Law” Article 145th provides:
