与“真普联”的公民提名、政党提名相比较,对“香港2020”的2017年行政长官的普选方案,社会上提出异议的不算多。但就抵触香港基本法第45条有关行政长官普选时的提名机制而言,“香港2020”方案与其相似,只是抵触的方式和程度有别。本文从提名委员会组成的“广泛代表性”、“均衡参与”原则、提名委员会的“机构提名”和“按民主程序提名”四个方面分析了“香港2020”与香港基本法第45条以及全国人大常委会有关决定的抵触之处。全国人大常委会应当以释法澄清香港社会包括“香港2020”对行政长官普选的种种误区,推动行政长官普选的进程。
Compared with the citizen nomination and political party nomination of “True Pursuit”, the election of the CE in 2017 for “Hong Kong 2020” does not raise many objections in the community. However, in contradistinction to Article 45 of the Basic Law of Hong Kong regarding the nominating mechanism for the election of the Chief Executive by universal suffrage, the “Hong Kong 2020” proposal is similar to the one with only a different way and degree of conflict. This article analyzes the “Hong Kong 2020” from the four aspects of “broad representation”, “balanced participation” principle, “nominating nomination” of nomination committee and “nomination by democratic procedure” “And Article 45 of the Basic Law of Hong Kong and the relevant decisions of the NPC Standing Committee. The NPC Standing Committee should clarify all the myths about Hong Kong society including the ”Hong Kong 2020" universal suffrage for the Chief Executive by universal suffrage, and promote the CE election process.
