经济全球化引发了国内外环境的各种变化,由此对政府规制劳动关系提出了新的要求。本研究基于国内外环境的变化分析,对政府在劳动关系中的角色和行为、劳动关系规制的方向进行了探讨。研究发现,国内外环境变化增大了集体劳动冲突触发风险,现有规制手段具有滞后性,使得劳工问题成为我国参与国际竞争与合作的门槛。而从制度经济学角度看,政府的角色在于维护劳动者自由劳动的权利和分享劳动成果的权利(即劳权),过往的规制忽视了劳权的保护。最后,论文针对分析结果,给出了中国现阶段劳动关系规制建议。
Economic globalization has triggered various changes in the environment at home and abroad, thus putting forward new requirements on the government’s regulation of labor relations. Based on the analysis of changes in the environment both at home and abroad, this study explores the roles and behaviors of the government in labor relations and the direction of labor relations regulation. The study finds that the changes in the environment both at home and abroad have increased the risk of collective labor conflicts and the existing regulatory measures are lagging behind, making labor issues the threshold for China’s participation in international competition and cooperation. From the perspective of institutional economics, the government’s role is to safeguard the workers’ right to work freely and to share the right to labor (ie, labor rights). Past regulations neglected the protection of labor rights. Finally, according to the analysis results, the thesis gives the suggestions on the regulation of labor relations in China at the present stage.
