非监禁刑具有诸多优势,因此世界各国都广泛适用非监禁刑罚。为使我国非监禁刑进一步完善和发展,促使我国刑罚更加公正、透明,就必须对非监禁刑的执行进行完善。我国非监禁刑目前存在问题有适用比例偏低;对非监禁刑执行的负面效果过于苛求;执行效果不佳;对非监禁刑执行的监督不足等。完善非监禁刑执行可以从以下几个方面进行:完善立法;建设非监禁刑执行队伍;提供经费保障;完善防控措施;发挥社会力量的作用。
Non-confinement sentences have many advantages, so non-custodial sentences are widely applied in all countries of the world. In order to further perfect and develop our non-custodial punishment and to promote a more fair and transparent penalty in our country, we must perfect the execution of non-custodial punishment. The current problem of non-custodial punishment in our country is that the applicable proportion is low; the negative effect on the execution of non-custodial punishment is too demanding; the enforcement effect is not good; and the supervision on non-custodial punishment is not enough. Improve the implementation of non-custodial sentences can be carried out from the following aspects: to improve legislation; construction of non-custodial execution team; provide funding protection; improve prevention and control measures; play a social role.
