2008年12月11日获得联合国大会通过的《联合国全程或者部分海上国际货物运输合同公约》,旨在顺应国际商贸发展,统一当下分散、落后的国际货物运输法。该公约在适用范围,承托双方权利、义务、责任,运输单证,货物控制权,程序性规则等方面均较既有海运公约和其他单式货物运输公约有较大突破,但同时也存在诸多不足和局限性。该公约就其制度本身而言,是国际货物运输法制的一次较大的发展,但其实施前景及对国际商贸实践的功过尚待时间去评判。
