自我国《物权法》于2007年出台之后,伴随着理论界的激烈探讨,学界对其中的占有理论又做了进一步深入的分析和阐释。有学者主张应该更进一步丰富占有的内容,例如将间接占有归入物权法的规定范畴之内,或者对占有辅助的含义应加以确认,将占有辅助的内容吸收进我国物权法的规定当中,为进一步完善我国物权法提供更完备的理论基础。
Since the “Real Right Law” of our country was introduced in 2007, along with the intense discussion of the theoretical circles, the academic circles made further in-depth analysis and explanation of the possession theory. Some scholars advocate that the content of possession should be further enriched, for example, the indirect possession should be included in the stipulation of the law of real right, or the connotation of possession should be confirmed, the possession of auxiliary content should be absorbed into the provisions of the Real Right Law of our country, in order to further improve China’s property law provides a more complete theoretical basis.
