促进和监督金融机构更多地承担保护金融消费者权益的责任,是一个全球性的监管课题。金融机构与消费者在建立金融契约关系前,金融机构应当就产品和服务的相关条款向消费者清晰履行说明义务,并使消费者充分理解约定内容,而自主决定是否与金融机构建立契约关系;在契约存续期间,金融机构应持续地运用恰当的方式、通过稳定的渠道保证消费者对说明信息的获取,以切实保护消费者的知情权、选择权和公平交易权。监管者应逐步提高监管的刚性约束,进一步规范说明义务的尽职履行。
It is a global regulatory issue to promote and monitor the responsibility of financial institutions to take greater responsibility for protecting the rights and interests of financial consumers. Before establishing a financial contractual relationship between a financial institution and a consumer, a financial institution shall clearly state its obligations of interpretation to consumers in accordance with the relevant provisions on products and services, and enable consumers to fully understand the content of the agreement and independently decide whether to establish a contractual relationship with a financial institution. During the existence of the contract, financial institutions should continue to use appropriate means to ensure consumer access to explanatory information through a stable channel in order to effectively protect consumers’ right to information, options and fair trade. Regulators should gradually increase the rigid constraints on regulation and further regulate the due performance of obligations.
