建立健全多元化纠纷解决机制是中央确定的一项重要司法改革任务,人民法院如何实现诉讼内外各种纠纷解决机制的功能互补、有机整合,进一步推动“大调解”工作体系建设,不断完善中国特色纠纷解决机制,这正是重新构建多元化纠纷解决机制应当回答的问题。笔者结合假期在法院工作的心得,探讨重构我国多元化纠纷解决机制的基本思路,以期为完善纠纷解决这一机制有所助益。
Establishing and improving the mechanism for resolving diverse disputes is an important judicial reform task set by the Central Committee. How the people’s courts can complement and integrate various dispute resolution mechanisms both inside and outside the litigation and further promote the construction of a working system for “major mediation” and continuous improvement Dispute resolution mechanism with Chinese characteristics, which is exactly the problem that should be answered to reconstruct the mechanism of dispute resolution. The author combines the experience of holiday work in the court, discusses the basic idea of reconstructing our country’s diversified dispute resolution mechanism, with a view to improving the dispute resolution mechanism.
