2012年日本著作权法修改中,导入的对于违法下载行为的刑事规制。这一规定体现了文化产业利益集团通过游说立法维护自身利益,而著作利用者的利益在立法过程中很难有效地得以反映,结果导致利用人权益较容易在政策定过程中被忽或牺牲的现象。此外该趋势亦有随着数字化技术的进步与国际著作权保护范围的扩张而进一步显现之虞。因此有必要研究日本这一立法趋势的来龙去脉,以期对中国正在进行的著作权法修改工作有所裨益。
2012 Japanese copyright law revision, the introduction of criminal acts for illegal downloading. This stipulation embodies the interest groups of cultural industries through lobbying legislation to safeguard their own interests, and the interests of the users of the writings are difficult to be effectively reflected in the legislative process. As a result, the rights and interests of the users are more likely to be neglected or sacrificed in the policy setting process phenomenon. In addition, this trend is also likely to become more apparent as digital technology advances and the scope of international copyright protection expands. Therefore, it is necessary to study the ins and outs of Japan’s legislative trend in the hope that it will be beneficial to the revision of the ongoing copyright law in China.
