“依法治国”中的法之意应当是良法,良法是善治的前提。良法的概念最早是由亚里士多德提出的,之后很多法学家也就良法的概念和良法的判断标准提出自己的看法。笔者认为,良法的判定标准不但要包括内容上的反映发展规律、体现正义、促进社会进步;而且还要包括形式上的结构严谨合理、体系和谐协调、语言规范统一。 The law of “governing the country according to law” should be good law and good law is the prerequisite for good governance. The concept of good law was first proposed by Aristotle, and many jurists also put forward their own views on the concept of good law and the standard of good law. The author believes that the criterion of good law should not only include the reflection of the law of development, the reflection of justice, and the promotion of social progress, but also include the formal structural rigor and reasonable system harmonization and harmonization of language norms.
