汉武帝把西汉王朝的盛世推向了巅峰,社会得到了极大发展。那么强大王朝的建立,其依靠的思想是所谓的“罢黜百家,独尊儒术”吗?汉武帝时期的社会物质背景究竟会产生怎样的法律精神,根据物质与上层意识形态的相互关系,社会物质背景与社会意识形态的相互作用,运用辩证唯物主义的思想从政治,经济,思想文化,法律等方面分析,得出罢黜实际是不存在的。现代社会任何一种法律抑或是政策的制定,都不可能脱离社会物质背景,都应该符合社会的实际需要。
